Proposition 65 updates. September 2004
Court approves Proposition 65 settlement
On August 31, the trial court in California formally approved the Proposition 65 settlement between a group of manufacturers and retailers and the plaintiff regarding allegations that consumers are exposed to lead from the outside surface of drinkware. No objections to the tentative settlement were filed by any parties, and the court did not suggest any alterations to the settlement which is now binding on the parties involved.
SGCDpro has published a summary of the settlement for members which includes details of possible warnings and suggested warning language as well as possible courses of conduct for companies that are not a party to the agreement. New Proposition 65 notices filed in California for souvenir and other glassware sold at retail
Multiple new Proposition 65 notices have been filed in California relating to allegations that consumers are exposed to lead from the outside surface of glass containers, drinkware, mugs and other ware. The ware in question was sold at retail, at restaurants and at amusement parks. The plaintiff in these new cases is represented by the same attorney who represented the plaintiff in the recently settled Proposition 65 drinkware cases described below. These new allegations were not part of the recent drinkware settlement.
