Proposition 65 notices filed for glassware and bottles at retail

January 2005

An additional 20 Proposition 65 notices have been filed in California in late December and early January alleging exposure to lead from the outside surface of glassware and bottles sold at retail.  The majority of the companies named in the notices are retailers including major retail outlets and souvenir stores; however, several glass decorators are named in the suits as well.  In addition, another restaurant is named as a defendant in these recent filings.

As previously reported, a significant number of Proposition 65 notices have been filed since the August 31, 2004 settlement between a group of manufacturers, importers, retailers and the plaintiff concerning allegations of lead exposure and decorated glass and ceramicware.  The plaintiff in these cases is represented by the same attorney who represented the plaintiff in the Proposition 65 drinkware cases that were settled on August 31.  These new allegations, however, are not part of that settlement.  SGCDpro, has scheduled a meeting with the state Attorney General's office to discuss the implications of these multiplying cases.

Andy Bopp, SGCDpro's Public Affairs Director, and Jim Calderwood, SGCDpro's General Counsel, will review Proposition 65 developments during SGCDpro's seminar program in Orlando on Monday, April 4.  Contact Andy Bopp if you have any questions, 703-838-2810.
